Sarbacane Software undertakes and encourages its customers to respect the laws and ethical rules regarding electronic communications.
Sarbacane Software is a member of the "Syndicat National de la Communication Directe" and therefore relies on its code of ethics of the direct electronic communication. Topics to which Sarbacane Software commits itself:Confidentiality of data which are submitted by our customers Data reported by our customers and then hosted on our routing platforms are completely confidential and shall not be subject to any disclosure. Sarbacane Software reserves the right to inquire such data only to verify the compliance with its Sending Charter before any campaign has been validated or following complaints from Internet users, Internet access providers or anti spam collectives. Respect privacy of any recipient getting the campaigns of our clients Each address used to send e-mails through our routing platform has been provided by our customers. By accepting the Sarbacane General Terms of Use, our customers commit themselves to the respect of all applicable laws including the Law "Informatique et Liberté" and the Law about the Digital Economy Confidence in France. Ensuring legality and cleanness of campaigns sent Sarbacane Software proceeds almost systematically to a verifcation of the content of each campaign sent through its routing platform. This verification aims to validate the compliance with the Sending Charter before campaigns are sent. The Sarbacane Software company can not be held responsible for the dissemination of documents which do not respect the Sending Charter. We invite our customers to always consult and respect this Sending Charter before sending a campaign through our routing platform. Data security All our servers composing the routing platform are stored in highly secured rooms in order to ensure an optimum confidentiality of data entrusted by our customers. The server maintenance is performed by highly qualified personnel working for the company Sarbacane Software. Liability Sarbacane Software is neither owner nor manager of the files entrusted to us by our customers. All the databases which are used by our servers are the property of our clients or companies specialized in selling and renting files. Sarbacane Software can not be held responsible for the way its customers are collecting these data. Sending CharterFirst of all, the customer commits itself to respect the licence contract of the software Sarbacane which he validated and thus accepted by the installation or the update / upgrade od the software. This contract can be consulted at any time in the online help of the software or by clicking on this link. Furthermore, the customer must follow these recommendations unconditionally: The platform can by no means be used to send a content qualified as violent, obscene, defamatory, offensive or discriminating. In addition to that, pornographic contents, casino games online, clairvoyance, etc.. are strictly prohibited. The customer commits itself to provide its recipients with a valid means so that they can oppose, for free and without any justification, the intended treatment of their personal data. For your information, Sarbacane Software would like to point out, that legislation which has to be taken into account is the one of the country where the Licensee sending e-mail is established. The client can not use the software to send e-mail for advertising purposes, without prior, free and specific agreement of the recipient of the messages if it bargains with personal data correspondence. Any failure to this Sending Charter sending may conduct to the blocking of the software license, temporarily or permanently, without compensation or payback. Anti-Spam policyIn case of abuse of one of our customers regarding the content of his message, the failure or malfunction of the principle of unsubscription, the collection method or more generally any other breach of legal obligations and the applicable regulations, we invite people to contact us at abuse@sarbacane.com. Please forward a copy of the message and the reason for your complaint. An complaints analysis and processing team has been set up at Sarbacane Software to act quickly on the users not complying with the charter to use the software Sarbacane. |
