What is the right to be forgotten?

This is the right to delete data, and only applies under certain conditions listed in the GDPR:

  1. Personal data is no longer necessary for the purpose for which it was collected or otherwise processed;

  2. The data subject withdraws the consent upon which the treatment is based, and there is no other legal basis for the treatment;

  3. The data subject is opposed to treatment (subject to conditions);

  4. Personal data has been subject to unlawful processing;

  5. Personal data must be erased in order to comply with a legal obligation provided by the EU law or by the law of the Member State to which the controller is subject;

  6. Personal data has been collected as part of the information society service offer referred to in Article 8 (1) of the GDPR (Consent of minors.)
